Cơ sở pháp lý – Yếu tố bắt buộc từ cơ quan quản lý  Quy định về việc công bố sản phẩm mỹ phẩm là một yêu cầu pháp lý mang tính bắt buộc, được xây dựng dựa trên các điều ước quốc tế và quy định nội địa, nhằm thống nhất quản lý chất lượng và an toàn sản phẩm trong khối ASEAN.  Thông tư 06/2011/TT-BYT và Hiệp định Mỹ phẩm ASEAN  Văn bản pháp lý nền tảng và quan trọng nhất điều chỉnh hoạt động này là Thông tư 06/2011/TT-BYT (Thông tư Quy định về Quản lý Mỹ phẩm) do Bộ Y tế ban hành. Theo đó: Điều 3, Khoản 1 quy định: “Tổ chức, cá nhân chịu trách nhiệm đưa sản phẩm mỹ phẩm ra thị trường chỉ được phép đưa sản phẩm mỹ phẩm ra lưu thông khi đã được cơ quan quản lý nhà nước có thẩm quyền cấp Số tiếp nhận Phiếu công bố sản phẩm mỹ phẩm và phải hoàn toàn chịu trách nhiệm về sản phẩm đã công bố.”  Quy định này hoàn toàn phù hợp với Hiệp định về Hệ thống Quản lý Mỹ phẩm ASEAN (ACD), theo đó, các quốc gia thành viên đều yêu cầu công bố trước khi lưu hành, nhằm tạo ra một thị trường mỹ phẩm an toàn và thống nhất trong khu vực.  Tính chất của mỹ phẩm và yêu cầu quản lý  Mỹ phẩm là sản phẩm tiếp xúc trực tiếp với cơ thể con người (da, tóc, móng, niêm mạc), do đó tiềm ẩn nguy cơ gây dị ứng, kích ứng, hoặc các vấn đề sức khỏe nghiêm trọng nếu chứa hoạt chất cấm hoặc nồng độ vượt ngưỡng cho phép. Vì vậy, công bố mỹ phẩm là hình thức kiểm soát sơ bộ, buộc DN phải cam kết về thành phần, xuất xứ, và tính an toàn của sản phẩm.  Mục đích cốt lõi của việc công bố sản phẩm mỹ phẩm  Việc yêu cầu DN thực hiện thủ tục công bố mỹ phẩm không nhằm mục đích hạn chế kinh doanh, mà phục vụ ba mục đích cốt lõi sau:  Kiểm soát thành phần và đảm bảo an toàn sản phẩm  Mục đích hàng đầu là bảo vệ người tiêu dùng. Thông qua hồ sơ công bố (đặc biệt là Phiếu kiểm nghiệm COA), cơ quan quản lý sẽ xác nhận: Sản phẩm không chứa các chất cấm theo danh mục cấm của Bộ Y tế và ASEAN. Nồng độ các chất hạn chế sử dụng (ví dụ như chất bảo quản, chất tạo màu) nằm trong giới hạn an toàn cho phép. Hạn chế rủi ro liên quan đến hàng giả, hàng nhái, hoặc hàng kém chất lượng, không rõ nguồn gốc.  Minh bạch hóa thông tin và tạo cơ sở cho hậu kiểm  Phiếu công bố mỹ phẩm là bằng chứng pháp lý xác nhận trách nhiệm của đơn vị đứng tên công bố. Việc này tạo ra cơ sở dữ liệu quốc gia thống nhất, giúp: Minh bạch hóa nguồn gốc, xuất xứ và người chịu trách nhiệm về sản phẩm trước người tiêu dùng. Tạo điều kiện thuận lợi cho các hoạt động hậu kiểm (kiểm tra sau khi lưu hành) của Thanh tra Sở Y tế và các cơ quan quản lý thị trường. Nếu sản phẩm sau hậu kiểm bị phát hiện không đúng với hồ sơ đã công bố, DN sẽ phải chịu trách nhiệm hoàn toàn.  Điều kiện tiên quyết để thông quan hàng hóa (Đối với hàng nhập khẩu)  Đối với mỹ phẩm nhập khẩu, Số tiếp nhận Phiếu công bố do Cục Quản lý Dược cấp là chứng từ bắt buộc phải nộp cho cơ quan Hải quan khi mở tờ khai. Hải quan sẽ từ chối thông quan lô hàng mỹ phẩm nếu DN không xuất trình được Số tiếp nhận công bố hợp lệ. Điều này đảm bảo hàng hóa trước khi vào Việt Nam đã được kiểm soát về mặt pháp lý và cam kết an toàn, tránh tình trạng nhập khẩu tùy tiện các sản phẩm không đạt tiêu chuẩn.  Hệ quả pháp lý khi doanh nghiệp không công bố mỹ phẩm  Việc lơ là hoặc cố tình không thực hiện thủ tục công bố sản phẩm mỹ phẩm sẽ dẫn đến những hệ quả pháp lý nghiêm trọng theo quy định hiện hành:  Phạt hành chính và đình chỉ hoạt động  DN kinh doanh mỹ phẩm chưa được công bố hoặc công bố sai sự thật sẽ bị xử phạt hành chính rất nặng theo Nghị định 117/2020/NĐ-CP (Quy định xử phạt vi phạm hành chính trong lĩnh vực y tế): Phạt tiền: Mức phạt có thể lên đến 50.000.000 VNĐ (đối với cá nhân) hoặc 100.000.000 VNĐ (đối với tổ chức) tùy theo mức độ và số lượng sản phẩm vi phạm. Hình thức xử phạt bổ sung: Tịch thu tang vật, đình chỉ hoạt động kinh doanh, và buộc thu hồi sản phẩm vi phạm.  Rủi ro về danh tiếng và mất uy tín kinh doanh  Khi bị cơ quan chức năng phát hiện và công khai về việc kinh doanh sản phẩm không công bố, DN sẽ phải đối mặt với: Thiệt hại danh tiếng: Mất niềm tin nghiêm trọng từ đối tác và người tiêu dùng. Cản trở kinh doanh: Bị hạn chế tham gia các chuỗi phân phối chính thức và các sàn thương mại điện tử lớn (thường yêu cầu giấy tờ công bố hợp lệ).  Kết luận  Công bố sản phẩm mỹ phẩm là một quy trình pháp lý bắt buộc, là điều kiện tiên quyết để sản phẩm được hợp pháp lưu hành tại thị trường Việt Nam. Quy định này không chỉ là rào cản hành chính mà là tấm lá chắn bảo vệ an toàn cho người tiêu dùng và tạo ra một môi trường kinh doanh mỹ phẩm lành mạnh, minh bạch.
